Funeral homes have a special obligation to the surviving family to treat the remains of the deceased with dignity and all due respect. It is unfortunate and seemingly distasteful to sue a funeral home but the severe emotional damage that can be done will prevent future mistakes by the same or other funeral homes in acting in a cavalier and uncaring manner.
